All sales are final. We do not accept returns except as expressly stated in the paragraph "right of withdrawal".
www.calabriapipe.com is a telematic site selling pipes, semi-finished products for pipes and various objects (hereinafter the Products).
All the Products offered are illustrated in detail on the home page of the Site, within the respective sections, divided by Product categories.
Access and use of the site are activities regulated by these General Conditions of Sale.
Access to and use of this website, as well as the purchase of products, presuppose the reading, knowledge and acceptance of these General Conditions of Sale.
The products purchased on the site are sold directly by "CALABRIA PIPE di Carlo Carlino" with registered office in Italy, Mandatoriccio (CS), Via Nazionale 195, REA n CS-216872,

OBJECT OF THE CONTRACT

"On-line" sales contract means the distance contract, the legal transaction concerning movable property and / or services stipulated between a supplier and a consumer and / or customer within an organized distance selling system by the supplier who, for this contract, exclusively uses the remote communication technology called "internet".
Each purchase transaction will be governed by the provisions of Legislative Decree n. 185/99 and, as far as the protection of confidentiality is concerned, will be subjected to the legislation referred to in Law n. 675/96 and subsequent amendments. All contracts, therefore, will be concluded directly through access by the consumer and / or customer to the corresponding website at www.calabriapipe.com where, following the indicated procedures, it will conclude the contract for the purchase of the goods. For distance contracts with consumers, the legislation envisaged by section II of Legislative Decree no. 206 of 6 September 2005.

ACCEPTANCE OF THE GENERAL SALES CONDITIONS

The contract stipulated between "CALABRIA PIPE di Carlo Carlino" and the Customer must be considered concluded with the acceptance, even if only partial, of the order by "CALABRIA PIPE di Carlo Carlino". This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure and to accept the general and payment conditions in full. Any right of the Customer to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or things, caused by the non-acceptance, even partial, of an order is excluded.

PROPRIETARY RIGHTS

The contents of the site www.calabriapipe.com , photos, videos, images, logos and any material of any other published form, including the menus, graphics and colors of the site are the property of CALABRIA PIPE.
The reproduction, in whole or in part, in any form, of the website, of its contents, without the express written consent of “CALABRIA PIPE by Carlo Carlino” is prohibited.
CALABRIA PIPE has the right to prohibit the reproduction, in any way of the contents present on the website.

PURCHASE METHOD

The customer can buy the products on the site www.calabriapipe.com.

The images and colors of the Products published on the Site may differ from the actual ones due to the local settings of the systems and / or tools used for their display, but this doesn’t give Customer the right to a refund or replacement of the goods, given that it does always the description of the product sheet.

Correct receipt of the order is confirmed by CALABRIA PIPE via an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will contain Date and Time of execution of the order and an "Order Number", to be used in any further communication with CALABRIA PIPE.

 The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to communicate promptly any corrections, using customer service. In case you need an invoice, the Customer must ask for it before placing the order and must insert the invoice request in the order notes, for accounting and fiscal reasons it is not possible to issue invoices after the order date.
In case of non-acceptance of the order, CALABRIA PIPE guarantees timely communication to the Customer.
We do not sell to people under 18 years of age. We reserve the right to cancel any order whose credentials may make us doubt their truthfulness.

BUYER'S OBLIGATIONS

The consumer and / or customer undertakes and, once the "online" purchase procedure is completed, undertakes to print and keep the present general conditions, which, moreover, will have already viewed and accepted as a necessary passage in the 'purchase, as well as the specifications of the product being purchased, in order to fully satisfy the condition referred to in art. 4, 5, 52 and 53 of the Decr. Legislative. No. 206/2005. The customer undertakes to collect the ordered goods and set a penalty of Euro 50.00 in addition to transport and storage costs in the event that the package should not be picked up for just cause. It is strictly forbidden for the purchaser to enter false and / or fictitious data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively their own real personal data and not of third parties, or of fantasy. It is expressly forbidden to make multiple registrations corresponding to the same person or enter data of third parties. CALABRIA PIPE reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers. The Client indemnifies CALABRIA PIPE from any liability deriving from the issuance of incorrect tax documents due to errors relating to the data supplied by the Customer, being the Customer solely responsible for the correct insertion.

TERMS OF PAYMENT

PayPal: in the case of purchase of goods with PayPal payment method (if available), together with the conclusion of the online transaction, PayPal will immediately charge the amount of the purchase made.
Paypal: in case of purchase of goods with paypal mode, the customer is still required to verify before sending the order that the transaction is made to the email address client@calabriapipe.com , official address of payments belonging to the site www.calabriapipe.com.

Bank transfer: in the case of purchase with payment by bank or postal transfer, the order will be processed after it has been credited (1-3 days). If we do not receive the credit within 7 days, the order will be canceled.
Cash on delivery: orders with payment at destination are accepted, valid only and exclusively on the national territory. This method includes an increase of the shipping cost equal to Euro 4.00 denominated under the item of collection costs, as expressly mentioned in the paragraph "Delivery methods and costs", the same that will be added to the ordinary expenses attributed to the national transport.

APPLIED PRICES

All product prices on sale on the Site are expressed in Euro (€) and are inclusive of Value Added Tax ("VAT").
The shipping costs and any other possible additional costs, including VAT and expressed in Euro (€), will be expressly and separately indicated in the order form before the user proceeds with the transmission of the same as well as on the confirmation e-mail of the 'order.

The price of the products can be changed without notice, provided that the price charged to the user will be the one published on the product sheet at the time the order is sent. The products will remain the property of CALABRIA PIPE until payment by the user of the purchase price, shipping costs and any other possible additional cost.

DELIVERY METHODS AND EXPENSES

CALABRIA PIPE delivers to all the countries indicated on the Site to the postal address specified by the Customer from Monday to Friday, during normal business hours, excluding national holidays & direct participation in events and fairs. The same will in any case be made known in advance by Newsletter or visual banners on the site www.calabriapipe.com.
Delivery costs, if present, are charged to the Customer and are clearly stated when the order is placed. Nothing is more due by the customer than the total order.

The delivery of the items is made through Postal Service or private courier (SDA, BRT, GLS) throughout the national territory.
Delivery times are approximately 3-5 working days from the sending of the order by the consumer.
The goods will be delivered while stocks last and in any case by order accepted by CALABRIA PIPE.

Fixed contribution for the National expedition: € 8.90.
Contribution for collection (only for cash on delivery): € 4.00.
The transport costs INTERNATIONAL (INTEREUROPEAN & EXTRAEUROPEAN) will be managed automatically by the system based on the actual weight and in any case specified before the conclusion of the order.
All Product prices are clearly indicated on the Site and delivery costs are shown at the time of the order.
If the ordered Products have to be delivered outside Italy, the Customer may be subject to import duties and taxes, payable once the package reaches the specified destination.
Any additional customs clearance costs will be charged to the Customer.
CALABRIA PIPE does not control these costs and cannot predict the amount, given that customs policies vary considerably from country to country with the consequence that the customer is invited to contact the local customs office for further information.

In the event that the shipment should end up in storage for any reason, the customer will have to repay the shipment directly to the courier upon delivery or alternatively he can collect the package free of charge in the SDA, BRT, GLS deposits.
The order processing time is to be considered indicative.
CALABRIA PIPE will fulfill the order, compatibly with stock availability, within 3-5 working days from the date of correct receipt of the same.
No responsibility can be attributed to CALABRIA PIPE in case of delay in the order or delivery of the order.
The delivery of the ordered is meant at street level.
Upon delivery of the goods by the courier / postman, the Customer is required to check:
- that the packaging is intact, not damaged or wet or otherwise altered, even in the closing materials (adhesive tape or strapping).
If you accept a tampered package there is no possibility to make a claim. We inform you that pursuant to Legislative Decree 22/5/1999 n. 185 and subsequent amendments, the goods travel at the risk of the recipient, so CALABRIA PIPE is not liable for any theft or damage. For the sake of completeness, we report an extract from the law decree regulating this topic: Legislative Decree 22/5/1999 n. 185 on distance contracts. Commercial sales transactions are governed by these sales conditions as per current Italian legislation. The Supplier makes the shipments to the Customer with selected express couriers and the goods travel in free port with the costs and risks of transport fully paid by the Customer. These expenses and other charges related to the transport and / or shipment of the products are counted and detailed in the order confirmation and in the purchase invoice or counted as the final amount in the receipt. Upon receipt of the goods at home, the Customer must verify the integrity of the packages.
In case of non-collection within 5 working days of the material in storage at the courier / post office warehouses due to repeated inability to deliver to the address specified by the Customer, the order will be returned to CALABRIA PIPE and the customer will be reimbursed the amount paid except for shipping costs and any other ancillary costs incurred.

In no case the ordered goods can be refused at the time of delivery, this circumstance will not be considered the application of the right of return, but contractual non-compliance.

RIGHT OF WITHDRAWAL

To exercise this right, the customer, within 14 days from the date of receipt of the goods, must contact customer service at info@calabriapipe.com stating that they wish to exercise the right of withdrawal, using the appropriate downloadable form:

Subsequently, the same must be sent by registered letter with return receipt, which must be received at the CALABRIA PIPE headquarters, no later than 14 (fourteen) working days from the date of receipt of the goods.
CALABRIA PIPE will also proceed, within 30 days from the return of the goods, to the re-credit of the amount after verifying the integrity of the goods and holding only the amount of the shipping costs. The refund will be made by bank transfer; it will be the customer's responsibility to promptly provide the bank details to be reimbursed (IBAN and current account holder).
The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packaging), kept and possibly used in the normal diligence, without any signs of wear or dirt. The right of withdrawal is in any case subject to the following conditions: the return costs are charged to the customer, the product, the packaging and the contents of the box must be returned new and undamaged.

 Furthermore the right of withdrawal does not apply to:

- Partially used products;
- Products damaged due to carelessness by the customer.

GUARANTEES

All our products are covered by the guarantees provided for by European regulations on consumer goods and differ according to the type of product.
The warranty does not apply if the defect or damage was caused by improper use, eg fall, break, etc.
Defects that occur due to wear, lack of or incorrect maintenance, improper use, tampering or voluntary and / or involuntary damage (knocks, falls, etc.) cannot be considered defects of conformity. The poor maintenance or the possible impact / fall of a product are sufficient causes to seriously compromise the functioning of the same, as well as the safety of its user. Any operating defects that occur due to poor and / or incorrect maintenance or improper use, cannot in any way be considered as conformity defects and affect the warranty on the product itself.
Returns must be sent in their original packaging and must be authorized by CALABRIA PIPE, by contacting customer service through the "Contact Us" form on the website after logging in and selecting the relevant order and product in question.

Friendly resolution of disputes

Pursuant to art. 14 of the EU Regulation n. 524/2013 we inform you that in the event of a dispute you may file a complaint via the European Union's ODR platform which can be reached at the following link: http://ec.europa.eu/consumers/odr/ .
